Partners and Associates

1. No Partnership or Association with hackersons.co.uk, either explicit or implied, may be made by any individual, business or organisation without the express permission of Hackersons Multimedia

Warranties

2. No information, either oral, written or electronically supplied by Hackersons Multimedia shall constitute a warranty or obligation unless expressly stated.

3. Under no circumstances will Hackersons Multimedia be liable for any direct, indirect, incidental, or consequential damages (including but not limited to loss of profits, business, anticipated savings, goodwill, use of data or other intangible losses) that result from either (i) the inability to use The Website or (ii) mistakes, omissions, interruptions, suspension or termination of the service therein, or (iii) accessibility issues.

4. The Website may contain links to other Web Sites which are completely independent of The Website. The Site Visitor agrees that Hackersons Multimedia has no control as to the content and nature of the websites linked to The Website and agrees that Hackersons Multimedia is not responsible for any loss or damage of any kind sustained as a result of the Site Visitor communicating, visiting or dealing with any of the companies or organisations included in the Business Listings, or with any companies or organisations associated there with.

5. By accessing or using any part of The Website, the Site Visitor agrees to be bound by these Terms and Conditions. Any Internet user not wishing to be so bound should not access or use The Website.

6. The Site Visitor may retrieve and display content from the site on a computer screen or print individual pages on paper. The Site Visitor may not copy, distribute, sell or publish any of the content.

7. The Site Visitor agrees that Hackersons Multimedia is not responsible for any loss or damage caused to the Site Visitor or equipment belonging there to as a result of downloading any material from The Website either intentionally or unintentionally, or from any business or organisation associated with the Website or listed thereon.

8. The client must own the copyright or have reproduction rights of all content supplied to Hackersons Multimedia for inclusion in the web design. The Client shall indemnify Hackersons Multimedia for any and all costs whatsoever in connection with ownership of the copyright or reproduction rights.

9. In the event that payment for any design work is not made in accordance with our payment policies, then all of client's rights in and to the design created, including any trademark property, will immediately revert back to Hackersons Multimedia.

10. Unless otherwise stated, Hackersons Multimedia own the intellectual copyright and any other rights in all design material on a Website designed or commissioned by Hackersons Multimedia This copyright and other rights do not extend to the GIFs/JPGs that are publicly available.

11. Hackersons Multimedia will retain the right to use any of the code, software, programs or other technologies that are developed for projects for any other purposes.

12. Subscription to all email and Web Space products is for a minimum of 12 months.

13. Site maintenance & hosting contracts are for a minimum of 12 months unless otherwise agreed.

14. Invoices must be paid within 30 days. Late payment will incur at the rate of 8 percent above the Bank of England base rate per month from the due date until the outstanding amount is paid.

15. No fees are charged for failed domain name registrations.

16. The domain name fee is payable on registration (and is non-refundable), failure to pay will result in the loss of this registration and the domain name being released for others to purchase.

17. Unless otherwise agreed each site has a limit of one gigabyte bandwidth per month, extra bandwidth is charged at 5 (five) UK pence per megabyte per month.

18. Hackersons Multimedia shall be entitled to vary its prices from time to time without prior notice and the Client shall be notified at all times.

19. All prices quoted to the Client for the provision of services by Hackersons Multimedia are exclusive of any value added tax for which the Client may be additionally liable at the applicable rate.

20. Hackersons Multimedia reserves the right to suspend all services without refund of any costs and without notice to our Client who uses Hackersons Multimedia facilities to send bulk unsolicited E-mail (spamming).

21. The Client is not allowed to serve information in the form of text or graphics from which may indirectly or directly lead to a contravention of the laws or regulations of the United Kingdom and in Parliament applicable to the export supply or use of goods or technology or publication of material which is prohibited such as pornography or serve such information either knowingly or unknowingly which in the absolute discretion of Hackersons Multimedia may bring Hackersons Multimedia into disrepute or may call into question any action taken by Hackersons Multimedia on the Client's behalf. Hackersons Multimedia reserves the right to terminate the services indefinitely to the Client until such contravention is corrected and/or rectified.

22. Without prejudice to any other conditions Hackersons Multimedia reserve the right to suspend services to a client who uses Hackersons Multimedia web space indefinitely in the event that any of these conditions are breached and suspension will continue until the cause of the breach is rectified or until otherwise agreed. Hackersons Multimedia enforces "Good Netiquette" practice and all clients using Hackersons Multimedia facilities and services are obliged to comply with this code of practice.

23. The minimum contractual period for the provision of services by Hackersons Multimedia is 12 months from the first day that the services are made available to the Client. This agreement should be deemed to expire only in the event that the Client sends one month's written notice no later than the 11th month after the supply of services stating its intention to terminate this agreement otherwise the following years annual fee for the services supplied to the Client shall become applicable and a liability of the Client.

24. If payment is not made on the due date Hackersons Multimedia shall be entitled without limiting any other rights it may have to suspend services & to charge interest on the outstanding amount (both before and after any judgment) at the rate of 8 percent above the Bank of England base rate per month from the due date until the outstanding amount is paid.

25. Hackersons Multimedia reserve the right to amend and update these Terms and Conditions at any time without notice.

It is important that, where possible and where relevant, all content for the site is supplied in electronic format. This can be via e-mail or by disk in a word document or text file format.
